ORDER
The petitioner has been arrayed as the sole accused in Crime No.836/2019 of Kayamkulam Police Station, which has been registered for offences punishable under Secs.354, 511 of Sec.376 of the IPC and &
Secs.10 read with Sec.9(l)(n), 12 read with Sec.11 of the POCSO Act, 2012.
2. The prosecution case in brief is that the accused is none other than the father of the victim and that on 18.03.2019 at about 10.30 a.m., the accused had outraged the modesty of the victim by catching on her breast and thereafter at about 2p.m. on the same day, he had attempted to commit rape on her when she was lying inside the bedroom of her house and that thereby the accused has committed the abovesaid offences. The petitioner has been apprehended in relation to this crime on 18.03.2019 and has been under judicial custody since then.
3. The crime was initially registered for offences punishable under Secs.354 and 511 of Sec.376 of the IPC and after investigation, the police had filed additional report before the competent court stating about the disclosure of additional offences as per the abovesaid provisions of the POCSO Act.
