Petitioner, a differently abled student aged 18
years has filed this writ petition claiming admission
to MBBS under the quota earmarked for differently
abled persons. Brief material facts for the disposal
of the writ petition are as follows;
2. Petitioner is suffering from MeningoMyclac
(Post Surgical) with Paraplegia and hence has
locomotive disability of the lower limbs to the
extent of 60%. It is pointed out that, petitioner has
passed the higher secondary examination, 2019 with an
aggregate of 85% in the science stream. Petitioner
appeared for National Eligibility cum Entrance Test
(NEET) UG - 2019 for admission to MBBS and allied
courses and has obtained 58.76 percentile. Accordingly
petitioner applied for allotment of seats to Medical
and allied courses to the 1st respondent as per
application dated 11.2.2019.
3. According to the petitioner, as per regulation
4(3) of the Regulation on Graduate Medical Education,
1997 as amended in 2019, petitioner is entitled to

apply under the PWD quota since he suffers from bench
mark disability. Accordingly, as per a notice dated
