J U D G M E N T

The petitioner was recruited as a provisional Conductor on daily wages basis through employment exchange in the year 1979 by the Kerala State Road Transport Corporation (hereinafter referred to as 'KSRTC' for short). The petitioner is one among 699 provisional Conductors whose services were regularised and appointed as Reserve Conductors with effect from 8.3.2001. Ext.P1 is the order of appointment. The petitioner was provisionally promoted as Conductor II Grade with effect from 27.8.2004 on completion of 240 days duty. Ext.P2 is the memorandum issued by the District Transport Officer of KSRTC which reveals that the petitioner would be on probation for a period of two years on duty with a continuous period of three years.

2. The petitioner sustained serious injuries while on duty and was in and out of the hospital for treatment. Exts.P3 to P8 reflects the treatment undergone and Ext.P9 disability certificate reflects his permanent disability at 10%. The petitioner was therefore given light duty in the Depot of KSRTC itself in view of the disability sustained on account of the accident while on duty.
