JUDGMENT

The petitioner has a family property near a temple which has been declared as an Archaeological monument. The petitioner wants to construct a building in his family property. In fact, the petitioner started construction after obtaining a permit from the Panchayat. But, he has been informed by the Senior Conservation Assistant of Archaeological Survey of India, the 2nd respondent herein that he cannot make the construction, without obtaining permission from the appropriate authority under the Ancient Monuments and Archaeological Sites and Remains Act. The petitioner has submitted an application for such permission. From Ext.P4, it is seen that the same has been forwarded to the 3rd respondent, who is the competent authority under the Act to consider such applications. The petitioner seeks expeditious consideration of the petitioner's application referred to in Ext.P4.
