JUDGMENT

The petitioner claims that he is the General Secretary of the Principal's Council of Unaided Colleges (affiliated to Calicut University) His grievance in the writ petition is about non inclusion of the names of all Principals of affiliated Unaided Colleges in the electoral roll for the proposed election to the Senate from the Constituency of Principals

2. The University notified election on 16.1.2018. The date of publication of electoral roll was 19.2.2018. In the electoral roll published, names of Principals of Unaided Colleges are not figured. The Association appears to have raised a complaint as per Ext.P3. That was responded by reply dated 3.3.2018 stating that only those Principals of affiliated colleges, whose appointments as Principals are approved by the University, alone have been included in the electoral roll of Principals. No election was conducted. The University is proposing to renotify.

3. There was some doubt in regard to the inclusion of Principals of Unaided Colleges in the electoral roll. That was settled by a large number of judicial precedents of this Court [see the judgments of the Division Bench of this Court in University of Kerala v. Sankaran Nampoot
