Heard Sri. Anoop V. Nair the learned counsel appearing for the Cochin
Institute of Science and Technology (appellant), who were arrayed as respondent
No.3 and 4 in the W.P(C). No.15212 of 2019. Also heard Sri. D. Kishore, the
learned counsel representing the respondents/writ petitioners. The APJ Abdul
Kalam Technical University of Kerala is represented by Sri. Elvin Peter, the learned
counsel.
2. The Writ Petitioners were pursuing their B.Tech Degree Course in the
appellant college but when they sought transfer from the college to another Self
Financing Institute, the same was not considered. Thus aggrieved, they filed the
W.P(C). No.15212 of 2019. As per the Ext.P1 norms issued by the University, inter-
college transfer is permissible, between self financing colleges. The projected
concern of the students was shortage of faculty and inadequate infrastructure in
the Appellant college.
3. In the earlier proceedings i.e., the W.P(C). Nos.14156 of 2019 and
14547 of 2019, the grievances of similarly situated students of the Cochin Institute
of Science and Technology, Ernakulam was considered and the learned Judge held
that the college cannot compel the unwilling students
