J U D G M E N T

Petitioner in WP(c).No.6004/2010 is Principal Sub Judge, North Paravur. Petitioner in WP(c).No.6005/2010 is the Judicial First Class Magistrate, North Paravur. According to the petitioners for the reason that the quarters available at North Paravur were not habitable, under the orders of this court, they had occupied private buildings.

2. In these writ petitions the prayer sought is to direct the

3rd respondent to issue non-availability certificate and to direct the 2nd respondent to fix the rent of the buildings. Counter affidavits have been filed by the 2nd respondent.

3. In the counter affidavit filed in WP(c).No.6004/2010, it has been stated thus.

“2. The request Ext.P3 and P4 of the petitioner is forwarded to Executive Engineer, PWD (Buildings) Division, Ernakulam o 4.2.2009 as per endorsement NO.A3-6754/09 dated 18.3.2009, as per endorsement No.A3-1429/06 respectively for submitting rent reasonability certificate and non- availability Certificate for fixing. The rent can be fixed only if these certificates are obtained from PWD authorities. Reminder was given to 3rd respondent to take necessary steps vide letter A3 WPC.No. 6004/2010 & anor.
