J U D G M E N T

The petitioner has filed this writ petition challenging Ext.P10 order dated 01.12.2015 issued by the Sub Collector, Alappuzha. The said order arises in the context of Clause 6 of the Kerala Land Utilization Order. In fact, the issue has already been decided in favour of the petitioner vide Ext.P9 judgment. In the above referred judgment, this Court held as follows :

“In that view of the matter, the condition imposed is set aside. The petitioner is free to utilize the land for any other purposes in accordance with law including construction of residential as well as commercial buildings.”

2. This Court in fact in the above judgment ordered that, to safeguard the interest of neighbouring owners, appropriate condition can be imposed by the Sub Collector. The judgment was rendered on 09.12.2015, it appears that the order rejecting the petitioner's request has been passed on 01.12.2015. The reason stated for rejection is that, the applicant has not signed the application and that, in the light of the report of the Village Officer, the application has to be rejected.
