JUDGMENT

The compensation is now being offered to the petitioner

pursuant to Ext. P5 award passed under the Land Acquisition

Act, 1894. But no such award could have been passed on

21.08.2014 after the commencement of the Right to Fair

Compensation and Transparency in Land Acquisition,

Rehabilitation and Resettlement Act, 2013. All that the

petitioner prays is that the receipt of compensation should not

prejudice his right under the Right to Fair Compensation and

Transparency in Land Acquisition, Rehabilitation and

Resettlement Act, 2013.

It is made clear that the receipt of compensation by

the petitioner will be subject to further determination of

compensation under the Right to Fair Compensation and

Transparency in Land Acquisition, Rehabilitation and

Resettlement Act, 2013. This is in view of Section 24(1)(a) of

the said Act and the receipt of compensation pursuant to

Ext.P5 award will not operate as an estoppel. Needless to say

that a fresh award would be passed under the Right to Fair

W.P.(C). NO. 5186 OF 2015 2

Compensation and Transparency in Land Acquisition,

Rehabilitation and Resettlement Act, 2013 notwithstanding

Ext.P5 award.

The writ petition is disposed of.
