JUDGMENT

Petitioners in the captioned writ petitions are one and the same and they are opposite parties in various complaints pending before the Consumer Disputes Redressal Forum, Alappuzha. These writ petitions are filed seeking to quash the complaints numbered as CC Nos.14/2015, 121/2016, 96/2016, 357/2016 and 94/2016. Separate narration of facts is not required in view of the question that are raised by the petitioners in these writ petitions.

2. Material facts are thus:-

Petitioners are the legal heirs of one late Dileep Kumar, who was running a partnership firm by name M/s. Vitoba Bankers in Cherthala. After the sudden and unexpected death of Dileep Kumar on 30.1.2014 the business suffered an unexpected set back. There upon, party respondents filed complaints before the CDRF, Alappuzha seeking recovery of amount deposited with the partnership firm. Petitioners are arrayed as opposite parties. Various contentions are raised by the petitioners before the Consumer Forum including the maintainability of the complaint alleging that, there is no defective service rendered by the petitioners so as to maintain the complaint before the Consumer Forum against them.
