JUDGMENT

The petitioner retired from service while working as Superintendent in the Kerala State Electricity Board Ltd (KSEB for short). This writ petition is filed challenging Ext.P6 order passed on 10.2.2017 by which Ext.P5 request submitted on 18.1.2017 for relinquishment of promotion to the post of Senior Superintendent was rejected.

2. Petitioner commenced his service as a Cashier in the KSEB in the year 1994. He got promotion as Senior Assistant. It is stated that on grant of grade promotion on completion of 10 years in that post, his post was re-designated as Superintendent. Though he was granted promotion as Senior Superintendent, as per Ext.P2 order on 03.10.2015, he opted for promotion as Divisional Accountant. Thereafter he was granted provisional promotion as Divisional Accountant, as per Ext.P3 order dated 11.1.2017 and posted him at Kattappana.

3. As petitioner was due to retire from service in July 2017 and he was undergoing treatment at Kottayam, he submitted Ext.P5 letter of relinquishment, stating that he was temporarily relinquishing his right for provisional promotion as Divisional Accounts Officer.
