JUDGMENT

Petitioner is the owner of a building constructed on a small plot of land comprised in re-survey No.180/2 of Puthenchira village in Thrissur District. He constructed the said building on the strength of Ext.P1 building permit granted by the second respondent. It is a two storied building having 12 units. It abuts the Kodungallur- Maniyankavu road. He let out the said shop rooms to different persons. Subsequently, the tenant occupying shop room bearing No.VII/80G gave its vacant position to the petitioner. Consequently, the petitioner applied for grant of licence for conducting a bakery in the said room. That application was rejected as per Ext.P4 dated 5.5.2014 assigning the reason that the building in question was constructed in violation of section 220(b) of the Kerala Panchayat Raj W.P.(C).12345/14 2 Act. The contention of the petitioner is that since he had effected construction of the building on the strength of Ext.P1 permit granted in the year 2008, the respondents would not be justified in rejecting the application for grant of licence in respect of the aforesaid room.
