JUDGMENT
The petitioner herein was a Senior Manager of the Nedungadi Bank Ltd., which was later amalgamated with the Punjab National Bank. While working as Senior Manager, disciplinary proceedings were initiated against him and he was subsequently dismissed from service on the allegation of misconduct. Eventually, challenging the disciplinary proceedings, he approached this Court by filing W.P(C) No. 1162/2004 against the order of termination. Meanwhile he attained the age of superannuation on 30.9.2003. Subsequently, the writ petition was allowed directing the respondent to pay half of the back wages for the period he was kept out of service till his super annuation. So also, directed to pay the petitioner all retirement benefits and to pay pension to the petitioner based on the last salary he had drawn, if he had been in service at the time of super annuation. The respondent filed W.A.No.97/12 against Ext.P1 judgment passed by the single Judge. The said writ appeal was dismissed as per Ext.P2 judgment dated 25.1.2010 affirming the findings in Ext.P1 judgment.
