Petition filed under Section 482 Cr.P.C.
2. The petitioner is the third accused in Crime No. 119 of 2018 of Oonnukal Police Station registered for the offences under Sections 489(B) & 489(C) of the Indian Penal Code. On 02.02.2018, he was found travelling in a car along with the co-accused, who hail from West Bengal. In the course of the journey the vehicle stopped at Irumbupalam and the first accused tendered a currency note of the denomination of Rs.2,000/- for purchasing some articles from a shop. It was found to be fake. The police was informed. Search by the police revealed that the second accused had in her possession some more fake currency notes. The police seized 10 currency notes of the denomination of Rs.2,000/-. Along with the fake currency notes, the police seized Rs.7,64,960/-. They were genuine notes. Accused 1 & 2 signed a statement in writing before the Superintendent of Women Prison and Correctional Home, Viyyur to the effect that they have no claim for the said amount. The petitioner claims that it is his money. His Claim Petition was dismissed by the learned magistrate by Annexure III order. This is sought to be set aside.
