J U D G M E N T
The petitioner is claiming the benefit of Ext. P4 notification dated 27.05.2013, whereby the ceiling for determining the creamy layer was enhanced from Rs.4.5. lakhs to Rs. 6 lakhs, so as to have admission to the Engineering Course in the OBC quota.
2. The case of the petitioner is that he belongs to Ezhava community and on participating in the Common Engineering Entrance Examination 2013-14, his name was included in Ext. P5 rank list. Originally, the petitioner did not claim the benefit of OBC reservation, in view of the fact that the annual income of the petitioner's family was certified as Rs.5,46,360/- as discernible from Ext.P3. Ext. P2 is the community certificate issued to the petitioner. But , by virtue of Ext.P4 notification, the petitioner being a member of OBC, as certified vide Ext.P2 and his family income now comes within the purview of reservation norms, he is liable to be considered for the benefit of OBC reservation. Hence this writ petition.
