JUDGMENT

The petitioners are all retired staff of the subordinate judiciary. According to them, they are all persons who have retired after the report of the Shetty Commission was accepted on 1-4-2003. Thereafter, the Hon'ble Supreme Court has directed by Ext.P1 order to report compliance with the recommendations of the Shetty Commission by 30/6/2005. As per a subsequent order, Ext.P2, the Supreme Court has again directed as follows;

“The report of the Shetty Commission, as regards the Judges of the subordinate courts, was filed in the year 1999 and it was made effective from 1/7/1996. The Shetty Commission also made its recommendations with regard to the members of the subordinate court staff in March, 2003. So far as the date of implementation of the recommendations of the Shetty Commission with regard to members of the subordinate court staff, we make it clear that it shall be made effective from 1/4/2003. “

2. As per a subsequent order dated 7/10/2009, Ext.P3, the Supreme Court has directed that the recommendations of the Shetty Commission be implemented with effect from 1/4/2003. Thereafter, according to the petitioners, the recommendations have been implemented with respect to
