J U D G M E N T

Clause 18(f) of Ext.P3 tender document is under challenge in this writ petition.

2. The petitioner is a registered partnership firm.

They are engaged in the business of transportation. The first respondent is a Government of Kerala undertaking engaged in the production of cattle feed. On 31.3.2016, the first respondent invited e-tenders for transportation of their finished products from their plants to the southern and northern regions of Kerala for a period of one year. Ext.P3 is the tender document obtained by the petitioner pursuant to the said tender invitation. Clause 18(f) of Ext.P3 reads thus :

“18. Copies of the following documents should be submitted along with the Technical Bid.

x x x x x x x x x x x x x x x x x x x x

(f) Registration Certificates of 15(Fifteen) trucks manufactured on or after 01.01.2007 registered in Kerala in the name of the tenderer and having valid goods carrier

permit in their own name in Kerala as on 26.03.2016. In case of Partnership firm/Company, the registration of the vehicle considered for qualification should be in the name of the firm/company itself. The vehicles registered in the personal name of the partners or share holders of th
