J U D G M E N T

Treated as admitted. Heard Sri.Santhosh P.Poduval, learned counsel appearing for the petitioner, Sri.K.P.Vijayan, learned standing counsel appearing for the first respondent, Sri.V.M.Krishna Kumar, learned counsel appearing for the second respondent and Smt.A.Lowsy, learned Government Pleader appearing for the third respondent.

2. The petitioner herein was a Sweeper in the service of the Thrissur Corporation. He retired from service on 31.5.2012 on attaining the age of superannuation. While in service he was allotted quarters No.12/25. The present number of the said quarters is 34/1602. This writ petition was filed on 28.11.2012 aggrieved by Ext.P3 notice dated 5.7.2011 whereby the petitioner was informed that unless the second respondent, who is none other than his sister, vacates the quarters allotted to him, retiral benefits payable to him would not be disbursed.

3. The fact that the second respondent is the petitioner’s sister is not in dispute. She has along with 13 other persons filed W.P.(C). No.8419 of 2012 in this Court wherein they have sought an order WPC No.20591/2012 2 directing the Thrissur Corporation to consider Ext.P12 representation produced therein,
