J U D G M E N T

Pursuant to an inspection conducted at the premises of the petitioners' industry, penalty was imposed under Section 126 of the Electricity Act, through an order passed by the 4th respondent, dated 04-06-2013. The petitioners have challenged the said order in a writ petition filed before this court, W.P (c) No.17125/2013. In Ext.P5 judgment this court found that the petitioners have got an effective remedy of statutory appeal. Hence the writ petition was disposed of reserving liberty to challenge the order in statutory appeal. On the basis of direction sought for consideration of a petition filed before the Kerala State Electricity Regulatory Commission under Sections 142 and 146 of the Electricity Act, 2003, this court had also issued direction to the 5th respondent to consider and dispose of the said petition. The present writ petition is filed against W.P.(c) No.20925/2013 -2-

the coercive steps of recovery initiated through Ext.P3 notice, for realising the amount of penalty imposed, on the ground that consideration of the application submitted before the 5th respondent is pending.
