The petitioner herein has been arrayed as the accused No.1 in the

instant Annexure-I Crime No.331/2019 of Thiruvambady Police Station,

which has been registered for offences punishable under Sections 370 &

354 of the IPC on the basis of the First Information Statement given by the

lady victim on 26.8.2019 at about 2 p.m in respect of the alleged incident,

which had happened on 27.7.2019. The petitioner has been arrested in this

case on 27.8.2019 and after his remand, he has been under detention since

then.

The prosecution case in short is that the petitioner is an elderly

senior citizen, aged more than 72 years and that the petitioner and his aged

wife are running a shelter home for destitutes in their place in question and

that according to the allegations made by the lady victim in her F.I.

Statement given on 26.8.2019, she was accommodated in the said shelter

home from 12.9.2018 onwards and that she is suffering from serious mental

ailments and that she had poured kerosene over her husband's body and set

him ablazed and though he was hospitalized, later, he had died and that she

was under the psychiatric treatment in the mental hospital Kuthiravattom,
