JUDGMENT

C.K.ABDUL REHIM, J.

Mat.Appeal No.834/2018 is filed against the judgment in O.P.No.614/2016 of the Family Court, Ernakulam. An original petition filed by the appellant seeking dissolution of the marriage, under Section 13 of the Hindu Marriage Act, 1955, against the respondent herein, was dismissed by the Family Court.

2. Mat.Appeal No.860/2018 is filed by the same appellant, who is the respondent in O.P.No.262/2017, which was instituted by the respondent herein, seeking restitution of conjugal rights, which was allowed by the court below.

3. During pendency of the above appeals, the parties have arrived at a settlement with respect to the issues involved in both the cases. A compromise petition, I.A.No.2/2018 was filed in both the above appeals, under Order XXIII Rule 3 of the Code of Civil Procedure. As per the terms of the compromise, the parties have agreed that there is no objection in allowing Mat.Appeal No.834/2018 and in allowing O.P.No.614/2016 dissolving the marriage existing between the parties. They have also agreed upon to file a joint petition under Section 13B of the Hindu Marriage Act, before this court along with an application to waive the statutory waiting
