The petitioner herein stands indicted as the 4th accused in SC
No.1131/2010 of 6th Additional Sessions Court, Thiruvananthapuram.
2. Petitioner submits that,he appeared before the court below
along with the co-accused. It emerges that on 1/8/2016, the petitioner
was absent and sections 82 and 83 Cr.P.C. steps were ordered against
him. Thereafter there were several postings. The petitioner herein
has approached this Court contending that, he is ready and willing to
appear before the court below and to participate in future proceedings.
However, his apprehension is that, in the light of the warrant issued
from the court below, his applications for bail and recalling the warrant
are not likely to be taken up on the same date of his appearance.
3. It seems that, the petitioner herein remained absent for almost
two years. Evidently, there are some laches on his part. However,
considering the entire facts, I am inclined to dispose of the
Crl.M.C.with a direction to the petitioner to surrender before the court
below within ten working days from today and to deposit one half of
the bond amount. If these conditions are satisfied, the court below
shall take up the petitioner's application
