JUDGMENT
Petitioner is working as the Secretary of the Pathiyankara Coir Service Society Ltd. No.507. Petitioner entered service of the society on 22.09.1983. The pay scale of the Secretary and other employees is decided by the managing committee of the society by its resolutions. Till the year 2000, the payment of salary to the employees was done in accordance with the resolutions of the Co-operative Society, and no objection from the Auditor of Co-operative Societies was raised against the pay scale of employees. From 2010 onwards, the salary and allowances of the employees of Coir Service Co-operative Society are governed by Exts.P2 and P3 Government Orders. The auditor had objected payment of salary in accordance with Ext.P3 Government Order.
2. It is submitted that, as far as Ext.P2 Government order pertaining to the period 2010-2012, there is no audit objection. For the period from 1999 to 2010, the salary was decided by the resolution of the managing committee and the same was disbursed to the petitioner.
