J U D G M E N T
The petitioner retired as manager of a Cooperative Bank. It is said that certain disciplinary action was taken against her alleging involvement in a fraud committed by another staff of the Bank where she was working. She filed an appeal before the Board of Directors as provided under the Rules. The Board of Directors was dissolved on 15.6.2011 and an Administrator assumed charge. The petitioner therefore submitted an appeal to the Administrator. The Administrator has come to a finding in Ext.P5 that the petitioner was not involved in any fraud and it is not possible for the Registrar to proceed against a retired employee under the Rules nor impose any penalty and so all further disciplinary proceedings had been dropped.
2. The complaint of the petitioner is that despite the fact that she retired on 28.2.2010, her service benefits had not been paid and therefore seeks a direction to the 3rd respondent to pay all the retirement benefits to the petitioner W.P.(C) No.29839/2011 as early as possible.
3. The additional 3rd respondent has filed a counter affidavit inter alia contending that though the petitioner is relieved from the charges levelled against her as per Ext.P5,
