JUDGMENT
The adverse order passed by the Consumer Disputes Redressal Forum, Thrissur vide Ext.P6 and Ext.P8 order of confirmation by the State Commission with regard to the 'deficiency of service' projected by the third respondent is under challenge in these writ petitions.
The petitioner is a Service Co-operative Bank, wherein the third respondent has effected some deposit based on Ext.P2 Circular dated 22.02.2003 issued by the Registrar of Co-operative Societies, as to the rate of interest payable . A resolution was taken by the petitioner Bank reducing the rate of interest to 8%. Pursuant to the said resolution, the position was communicated to the third respondent vide Ext.P3, whereupon the third respondent filed Ext.P4 complaint before the CDRF, Thrissur alleging deficiency of service. The matter was considered and Ext.P6 verdict was passed against the petitioner and in favour of the third respondent, which was subjected to challenge by W.P.(C)No.30923 & 30952 OF 2011 way of Ext.P7 appeal before the State Commission, wherein interference was declined and the appeal was dismissed confirming Ext.P6. This in turn is under challenge in these writ petitions.
