JUDGMENT
The grievance of the petitioner herein is that the Kerala State Consumer Disputes Redressal Commission (hereinafter referred to as 'State Commission' for short), is not considering its application Ext.P3 filed in C.C.No.42 of 2015, to recall the 2nd respondent-PW1 and is proceeding to hear and dispose of the matter.
2. Petitioner is the opposite party in C.C. No.42 of 2015 filed by the 2nd respondent herein before the State Commission. The petitioner submits that on 4.12.2015, the State Commission had, after marking Exhibits A1 to A16 produced by the complainant, appointed an Advocate Commissioner to record the cross examination of 2nd respondent; after the cross examination held on 04.01.2016, the 2nd respondent produced Exts.A17 to A24 and on the basis of order dated 25.01.2016 of the State Commission to record the cross examination with respect to those documents, 2nd respondent was cross examined on 19.03.2016. It is stated that in the meanwhile, 6 documents were produced by the complainant before the State Commission on 14.3.2016; but no orders were passed regarding the examination with respect to those documents.
