JUDGMENT

Pursuant to Ext.P1 tender notice dated 5.6.2013 issued by the second respondent for the supply of 10,000 MT of rubble boulders, the petitioner submitted Ext.P2 bid. Three months thereafter, the second respondent decided to cancel Ext.P1 tender and to invite fresh tenders for supply of the goods. Thereupon Ext.P3 letter dated 10.10.2013 was sent to the petitioner. He was also informed that on getting a request from him, the earnest money deposit will be refunded.

2. The petitioner did not challenge Ext.P3 immediately.

Instead he sought information under the Right to Information Act, 2005 from the information officer of the second respondent as to whether the fourth respondent had participated in the tender and whether he has produced the certificate referred to in Ext.P4 letter. The Public Information Officer of the second respondent thereupon sent a letter dated 15.11.2013 in reply, stating that the fourth respondent had not produced the certificates referred to in Ext.P4 letter. The petitioner thereupon sent Ext.P5 letter dated 8.11.2013 to the Information Officer of the second respondent and asked for further information including the reason why a decision was taken to can
