This Writ Petition, styled in the nature of a Public Interest
Litigation, is preferred by a social worker who came to know from
newspaper reports that the State Government had decided to grant
licenses/permissions for establishing distilleries and breweries across
Kerala, and that the said decision was subsequently withdrawn by the
State Government. In the Writ Petition, the prayer is essentially for a
declaration that the issuance of the various Government orders issued in
connection with the proposal for grant of license, as also the withdrawal
of the said proposal, are illegal in as much as they amount to an abuse
of the power of the Government to grant the privilege of establishing
breweries and distilleries. It is also the case of the petitioner in the Writ
Petition that in any future consideration for grant of the privilege, the
State Government should adopt and publicize a transparent policy for
considering all future applications for breweries and distilleries licenses.
2. When the matter came up for admission, the learned
Government Pleader produced for our perusal a Government Order,
