JUDGMENT

The petitioner is the manager of St.Mary's ALPS, Marypuram in Kasaragod district. The said school is under a Corporate Educational Agency of the Diocese of Thallicherry. The agency itself is stated to be a Corporation of primary, secondary and training schools established under the Catholic Diocese of Thallicherry. In the writ petition Ext.P1 is produced as the Constitution of the Corporation, of which the Bishop of Thallicherry is the legal and constitutional head. Ext.P1 also deals with the rights and duties, as also the appointment of correspondents etc., in connection with the management of the schools. In the writ petition, the petitioner is aggrieved by the action of the 2nd respondent in not forwarding an application, which it had preferred seeking financial assistance from the Central Government in terms of Ext.P2 scheme, to the 3rd respondent. Ext.P2 scheme facilitates the education of minorities by augmenting and strengthening school infrastructure in minority institutions in order to expand facilities for formal education to children of minority communities.
