2018 Supreme(Online)(KER) 37065

SODARAN – Appellant
Versus
STATE OF KERALA – Respondent

Advocates:
['P RAVEENDRAN PILLAI', '', 'SMT INDIRA RAVEENDRAN', 'SMT R DEVI SHRI']

Petitioners are the accused in C.C. No.360 of 2014 on the

file of the Judicial Magistrate of First Class-III, Punalur. They are

alleged to have committed the offences under Sections 120B,

403, 406, 417, 419, 420, 465, 468 and 471 IPC. The

proceedings are sought to be quashed on the ground that the

allegations are improbable and that a person cannot be

proceeded against for the offences under Sections 406 and 420

IPC simultaneously and there was no proper investigation.

2. Heard the learned counsel for the petitioners and the

learned Public Prosecutor.

3. The grounds stated in the Crl.M.C. are not sufficient to

invoke the jurisdiction of this court under Section 482 Cr.P.C.

This Crl.M.C is not maintainable. It is accordingly

dismissed.
