JUDGMENT
This writ petition has been filed by the petitioner, praying that Ext.P5 application for stay, filed by them in Securitisation Application No. 270 of 2017, now stated to be pending before the Debts Recovery Tribunal (DRT for short), Ernakulam, be directed to be taken up and disposed of.
2. When this matter was considered by me on
30.11.2018, I had ask the Registry of this Court to contact the Tribunal and verify the time-frame within which the I.A can be taken up and disposed of. In pursuance to this, the Presiding Officer of the DRT-II, Ernakulam has addressed a letter to the Registrar (Judicial) of this Court to inform that the I.A will be taken up soon and disposed of after hearing the parties.
3. The learned counsel for the petitioner today informs me that, presumably on account of the orders of this Court, the DRT has now taken up the I.A by suo moto advancing its hearing and that the parties have been heard and orders thereafter reserved. He says that until such time as the DRT issues orders on the I.A, the Bank may be directed to defer all action under the Securitisation and Reconstruction of Financial Assets and Enforcement of Securities Interest Act ('the SARFAESI Ac
