Heard Sri. Asok M. Cherian, the learned Standing Counsel appearing for the

appellants. Also heard Sri.Neeraj Narayan, the learned counsel appearing for the

respondent No.1/writ petitioner.

2. This appeal is filed by the Mahatma Gandhi University authorities. They

challenge the judgment dated 15.10.2018 granting relief to a law student who was

pursuing his LLB Course and secured low marks in the internal assessment. The learned

single Judge allowed the W.P.(C) No.30165 of 2018 and issued direction to the Principal,

Government Law College (respondent No.2) to forward the writ petitioner's request to

the University, to enable him to redo the internal assessment in the papers pertaining to

the Law of Contract and Land Law in the LL.B. Curriculum.

3. The learned Standing Counsel appearing for the appellants would refer to the

University order dated 28.6.2003 (Annexure I) to point out that under the University

norms, the students who wish to re-apply for their internal examination, are entitled to

only one opportunity but this must be availed within one year of completion of the LLB

Curriculum. The counsel then refers to the communication dated 29.6.2015 (Ext.P3) to
