This revision case was filed under Sections 397 Cr.PC. and 482 Cr.P.C.,

assailing the order dated 30.12.2020 passed by the learned Chief Judicial

Magistrate, Chandel, in Cril. Misc. Case No. 54 of 2020 and seeking a direction to

the police authorities not to file a Charge Sheet in relation to FIR No. 25 (11) 2020

CDL-PS, registered under Sections 153 A, 504, 505, 506 and 34 IPC along with

Section 4 of the Explosives Substances Act, 1908. By the order dated 30.12.2020,

the learned Chief Judicial Magistrate, Chandel, had issued a warrant of arrest

against the petitioner herein and two others.

By order dated 09.03.2021 passed in this revision, this Court directed the

police authorities not to arrest the petitioner pursuant to the impugned order. This

order is still in operation.

While so, Mr. Athouba Khaidem, learned PP, appearing for the

respondents, would inform this Court that the police authorities completed the

investigation in the case and filed a charge sheet in relation to the aforestated FIR

on 11.05.2021 before the learned Chief Judicial Magistrate, Chandel. Learned PP

would further state that in the light of this development, the question of the

petitioner being arrested at this stage would not arise. He would point out that the

prayer in this revision with regard to directing the police not to file a Charge Sheet

has worked itself out, as there was no order passed by this Court interdicting the

police from doing so and in consequence, the Charge Sheet has already been filed.

Given the aforestated facts, the order dated 30.12.2020 passed in

Cril. Misc. Case No. 54 of 2020 can no longer be acted upon in so far as it pertains

to the petitioner, as the Charge Sheet has already been filed. The result of the case

has to be awaited before any further action.

Further, the prayer of the petitioner to restrain the police from filing a

Charge Sheet no longer survives for consideration in the light of the filing of the

Charge Sheet on 11.05.2021.

With these observations, the Criminal Revision is disposed of.
