Mr. Jyotsana, learned counsel, appears for the applicants.

This miscellaneous application has been filed for condoning the delay

of 73 days in filing the appeal.

Ms. Ph. Sarvodaya Lakshmi, learned counsel for the respondents,

strongly objected on the ground that sufficient cause for the delay has not been

shown.

However, considering the nature of arguments advanced by both the

parties and the reasons for the delay shown in the application, we are inclined to

condone the delay of 73 days in filing the appeal.

MC (W.A.) No. 97 of 2023 is allowed condoning the delay of 73 days

in filing the appeal.

Registry is directed to number the appeal, if it is otherwise found to

be in order, and post the same for admission on 30.08.2023.
