Challenge in the present writ application has been made to the time gr
anted to the petitioner for complying with the conditions imposed by the Superintendent of Exc
ise, Rayagada under cover of his letter dated 23.09.2015 under Annexure-4.
Learned counsel for the petitioner submits that the land owner has ini
tiated steps for conversion of the land in question and for executing the necessary lease deed
and registration of the same. Accordingly, representation has been made by him to the Superin
tendent of Excise and getting no response thereof, the writ application has come to be filed.
Considering the submissions made by the learned counsel for the petiti
oner as well as learned counsel for the State, we direct that the conditions imposed by the Su
perintendent of Excise, Rayagada under Annexure-4 shall be complied with positively by the end
of January, 2016 and till such date, the petitioners operation at
