This matter is taken up through hybrid arrangement

(virtual/physical mode).

The Appeal under Order-43, Rule-1(t) of the Code of Civil

Procedure (for short ‘the Code’) has been filed in questioning an

order dated 14.12.2017 passed by the learned District Judge,

Deogarh in CMA Case No.04 of 2014.

By the said order the Court below has rejected the

application filed by the present Appellant under Order-41, Rule-19

of the Code to readmit the appeal on payment of court fees of

Rs.3021/- and cost, pursuant to the order passed by this Court in

CRP No.14 of 2003.

It may be stated here that in filing the First Appeal in the

court of the learned District Judge, i.e., Title Appeal No.7 of 2002,

this Appellant had prayed to declare him an indigent person and
