This matter is taken up through video

conferencing because of COVID-19.

Heard Dipendu Sundar Ray, learned counsel

for the petitioner and Mr. Prassanajit Mohapatra,

learned Additional Standing Cousnel for the State.

In the present writ petition, the petitioner

has sought for direction to the Collector and District

Magistrate, Balasore-opposite party no.2 to grant

Financial Assistance as well as to grant death benefit to

the petitioner along with his family members of the

deceased Anganwadi Worker of the Ishani Anganwadi

Center of Sargaon Gram Panchayat under Balasore

Sadar Block in the district of Balasore in consonance

with the resolution dated 04.08.2020.

Learned counsel for the petitioner submits

that the deceased Anganwadi Worker of the Ishani

Anganwadi Center of Sargaon Gram Panchayat under

Balasore Sadar Block in the district of Balasore was

working in active line of duty in fighting Covid-19

pandemic sincerely and died as a Corona Warrior.

Further, learned counsel for the petitioner

submits that if a direction would be issued to opposite

party

no.2

to

consider

the

comprehensive

representation under Annexure-4 and dispose of the

same on its own merit in accordance with law within a

stipulated time, then the grievance of the petitioner

shall be redressed.

Mr. Mohapatra, learned Additional Standing

Cousnel for the State, however, has no serious objection

to that course of action.

Considering the limited nature of grievance

and without delving into the merits of the case, the writ

petition is disposed of with a direction that the Collector

and District Magistrate, Balasore-opposite party no.2

shall do well to consider the representation of the

petitioner under Annexure-4 in the light of the

Resolution No.22073 dated 04.08.2020 and dispose of

the same in accordance with law, as expeditiously as

possible preferably within a period of eight weeks from

the date of production of certified/authenticated copy of

this order.

The opposite party no.2 shall

act on

production of certified/authenticated copy of this order

along

with

the

copy

of

the

writ

petition

and

representation.

As restrictions are continuing due to COVID-

19 pandemic, learned counsel for the parties may

utilize the soft copy of this order available in the High

Court’s official website or print out thereof at par with

certified copies in the manner prescribed, vide Court’s

Notice No. 4587 dated 25.03.2020.
