Heard Mr. B. Mohanty, learned counsel for the petitioner and Mr. P.K. Mohapatra, lear

ned counsel for opposite party.

The petitioner has filed this application seeking to quash the order of dismissal dat

ed 28.04.1994 passed by the disciplinary authority in Annexure-6 and consequential confirmatio

n made by the appellate authority in Annexure-8 dated 07.10.1994.

The petitioner, while working as a clerk in Belpahar Central Bank of India, allegatio

n of commission and omission has been detected in respect of opening of home savings safe acco

unt. Accordingly, a memo was issued to him on 26.03.1993 calling upon him to file show cause r

eply. Thereafter, one H.K. Kar was appointed as Enquiry Officer to hold the inquiry and accord

ingly inquiry was conducted. Though petitioner was sought to engage legal practitioner, the sa

me has not been allowed. Subsequently, the petitioner sought for inquiry proceeding for re-exa

mine and cross examine the witnesses, i.e., M.W. 1, 2, 3 and 7, but the same was also rejected
