Heard the learned counsel for the petitioner and learned counsel for t

he State.

This is an application under Section 439 Cr.P.C. in connection with C.

T. Case No.186 of 2015 arising out of Chandili P.S. Case No.161 of 2015 pending in the Court

of learned Special Judge, Rayagada for offences punishable under sections 366/376(2)(i) of Ind

ian Penal Code and section 6 of Protection of Children from Sexual Offences Act, 2012.

The petitioner moved an application for bail before the learned Specia

l Judge, Rayagada which was rejected on 05.01.2016.

Learned counsel for the petitioner submits that the petitioner is in custody s

ince 04.12.2015 and after completion of investigation, charge-sheet has been submitted under s

ections 366/376(2)(i) of Indian Penal Code and section 6 of Protection of Children from Sexual

Offences Act, 2012. In support of such contention he files the certified copy of the charge-s

heet which is taken on record. The learned counsel for the petitioner further submits that in

the 164 Cr.P.C. statement, the victim has not alleged anything regar
