Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.1836 of 2016 on the file of learned S.D.J.M

., Balasore registered under Sections 498-A/323/376/377/506/294/34, I.P.C. read with Section 4

of the D.P. Act.

The informant alleged that after her marriage, she knew about the impotency of her husba

nd. The present petitioner is the husband, who allegedly tried to commit some unnatural offenc

e towards the informant and forced her to keep physical relationship with her in-laws.

Learned counsel on behalf of the State placed the statement of the victim recorded under

Section 164, Cr.P.C., which is almost duplicate of the F.I.R. It is seen from the F.I.R. that

the informant was brought back to her parental house after twenty days of her marriage and sh

e is now living with her family members.

Considering the submissions and the circumstances, it is directed that the petitioner on

surrender before the learned S.D.J.M., Balsore in the aforesaid case shall be released on bai

l by furnishing bond of Rs.15,000/-(rupees fifteen thousand) with one surety for
