1. This matter is taken up through virtual/physical mode.

2. By filing the present writ petition challenge has been

made to the illegal actions of the Bank authorities in not

extending the benefits of Debt Waiver and Debt Relief

Scheme, 2008 to the petitioner (who by availing an

agricultural loan has purchased a Tractor for agricultural

purpose) on the plea that the petitioner is the owner of more

than 5 acres of land, whereas the petitioner asserts that he

owns 5 acres of land along with other co-owners who are

shareholders of the same land, thereby is fully eligible to the

benefits under the Waiver Scheme.

3. Although notice was issued vide order dated 20th March,

2012, however the service upon the Union Bank of India

and others could not be effected.

4. At the time of hearing, Mr. H. K. Mohanta, learned proxy

counsel appearing for the petitioner states that he has no

instructions in the matter and probably by efflux of time the

present writ petition has become infructuous.

5. In view of the above submission, the writ petition is

dismissed as infructuous.

However, liberty is granted to the petitioner to seek

its revival by making an application within six weeks from

today in case any cause of action still survives.
