Petitioner has filed this application under Section 482 Cr.P.C. challenging th

e order dated 30.11.2012 passed by the learned S.D.J.M., Jajpur in I.C.C. No. 370 of 2012. The

court below taken cognizance of offence under Sections 341,323,294,506 of the I.P.C. read wit

h Section 3 S.C./ST (PA) Act against the petitioner and issued summon to the petitioner.

Learned counsel for the petitioner submits that initially the complainant has

filed I.C.C. No. 261 of 2008 and the same was sent to Police for investigation under Section

156(3) of the Cr.P.C. After investigation the case was registered as G.R. Case No. 596 of 2008

. The police has already filed final form on completion of investigation. Thereafter the compl

ainant has filed a protest petition registered as ICC Case No. 370 of 2012, the court below on

perusal of record passed the impugned order.

Considering the above facts and circumstances as the court has taken cognizanc

e and issued summon to the petitioner, this Court is not inclined to interfer
