Heard Mr. P.K. Rath, learned counsel for the petitioners, learned Central Go
vernment Counsel Mr. Aurovinda Mohanty, who has filed memo of appearance in the Court today an
d learned Addl. Government Advocate Mr. K.K. Mishra.
The petitioners, being the resident of Sherpur Grama Panchayat, have filed thi
s writ application seeking for quashing of Annexure 5 and 6. Annexure-5 and 6 are revised list
of beneficiaries for allotment of house under the schemes like Pradhan Mantry Awas Yojana, Bi
ju Pucca Ghar Yojana etc. The grievance of the petitioners is that, as per the guidelines issu
ed by the Union of India in Annexure-1, which is also adopted and re-issued by the State Gover
nment in Annexure-2 and as per the scheme, the name of the persons, who have already given hom
estead, should be deleted from the auto generated list. Though that is being done, the grievan
ce of the petitioners is that instead of serially taking the rest of the applicants, the discr
imination is meted to the persons, who are in the top of the list, after deletion of the name
by benefited persons, their names are appearing at the bottom of
