Heard the learned counsel for the petitioner and

the learned counsel for the State.

The petitioner being in custody in G.R. Case

No.312 of 2019, arising out of Boipariguda P.S. Case

No.42 of 2019, pending in the court of the learned

S.D.J.M., Jeypore, has filed this petition for his release

on bail. The offences alleged against him are

punishable under Sections 376(2)(n) and 417 of I.P.C.

The prosecution allegation reveals that the

petitioner stated to have kept physical relationship

with the victim and when the family members of the

petitioner made protest such relationship of the

petitioner and the victim, the petitioner left her and

thereafter he did not accept the victim and, as such,

F.I.R. was lodged. The victim appears to be major.

Investigation in this case has been completed and

charge-sheet has already been filed. No doubt,

allegation of forcible sexual intercourse has been made,

but considering the nature of accusation, character of

materials appearing again
