Heard Mr. Asok Mohanty, learned Senior Advocate on behalf of the petitioner.

Learned counsel for the petitioner submitted that a notice was published in the Oriya

daily newspaper Sambad on dated 19.06.1998 by the Odisha Pollution Control Board indicating th

erein that the Board has decided that the hotels/lodging houses using 20,000 liters of water o

r more per day (100 persons @ 200 liter per person) are to apply for consent of Board to estab

lish and to operate in the whole State of Orissa. It is further indicated in the notice that o

ther hotels and lodgings using less than 20,000 liters of water approximately must provide sep

tic tanks followed by soak pit construction as per BIS specification or discharge to Municipal

sewer or drain after pre-treatment and with permission from concerned Municipalities. It is t

he further contention of the learned counsel for the petitioner that the petitioner who is the

proprietor of M/s. Hotel New Shankar International is having a licence which has been annexed

to the writ petition as Annexure-7 which indicates that he has been authorized to receive onl
