This petition challenges the order dated 29.1.2016 passed by the learned Civil Judge (Jr.Divis

ion), Jharsuguda in C.S.No.16 of 2014, vide Annexure-4. By the said order, the learned trial c

ourt allowed the composite application of the plaintiff under Order 1 Rule 10 C.P.C. for imple

adment and Order 6 Rule 17 C.P.C. for amendment of the plaint.

The opposite party as plaintiff instituted the suit impleading the petitioner

as defendant for declaration that the order of transfer from Jharsuguda to Talcher is illegal.

Pursuant to issuance of summons, the defendant entered contest and filed a written statement.

While the matter stood thus, the plaintiff filed a composite application under Order 1 Rule 1

0 C.P.C. and Order 6 Rule 17 C.P.C. In the said application, the plaintiff proposed to implead

one Mr.Mrutyunjay Karmakar and Indian Oil Corporation Ltd. as parties and claimed damages to

the tune of Rs.2,03,600/-. The learned trial court allowed the composite application.

Heard Mr.Mohanty, learned counsel for the petitioner and Mr.Satpathy, learned

counsel for the opposite party.
