Heard learned counsel for the petitioner.

By way of this writ petition, the petitioner has

challenged the letter dated 3.8.2018 passed by the

Commissioner of Excise, Odisha, Cuttack-opposite party No.2

rejecting

the

shifting

proposal

of

the

Collector,

Jagatsinghpur-opposite party No.3 dated 13.6.2018 in

respect of Sandhakud No.1 IMFL OFF shop from existing site

to new site over Plot No.423, Khata No.29, Mouza-

Bijaychandrapur within Paradeep Municipality for the

remaining period of the year 2018-19.

Learned counsel for the petitioner has submitted

that the Hon9ble Supreme Court in the case of Arrive Safe

Society of Chandigarh V. The Union Territory of

Chandigarh & another passed in Special Leave Petition

(Civil) No.10243 of 2017, wherein in paragraph-7 has held

as under:

<7. The purpose of the directions contained in

the order dated 15 December 2016 is to deal

with the sale of liquor along and in proximity

of highways properly understood, which

provide connectivity between cities, towns and

villages. The order does not prohibit licensed

establishments within municipal areas. This
