This is an application under section 438 of Cr.P.C. for

grant of anticipatory bail to the petitioners in connection with

Ganjam Marine P.S. Case No. 30 of 2021 corresponding to

G.R. POSCO No.999 of 2021 pending in the Court of learned

Addl. Sessions Judge -cum- Special Court under POSCO Act,

Berhampur for the commission of the alleged offences

punishable under sections 363, 366, 344, 376(3), 376(2)(n),

506/34 of the Indian Penal Code and section 6 of the POSCO

Act.

Perused the F.I.R. annexed to the anticipatory bail

application.

In view of the 164 Cr.P.C. statement of the victim, who

is aged about sixteen years and the nature and gravity of

accusation, while not inclining to grant anticipatory bail to the

petitioners, liberty is granted to the petitionera to surrender

and move for bail in the Court below within a period of four

weeks from today in the event of which the learned Court

below shall dispose of the same in accordance with law. The

case records shall be made available to the Court concerned

for disposal of the bail application.

The ABLAPL stands disposed of.

The interim order dated 18.08.2021 stands vacated.

Issue urgent certified copy as per Rules.
