This is an application under Section 439 Cr.P.C. in connection with G.R. Case
No.918 of 2015 arising out of Bolangir Town P.S. Case No.417 of 2015 pending in the Court of l
earned S.D.J.M., Bolangir for alleged commission of offences punishable under sections 366/323
/376/506/34 of the Indian Penal Code.
The petitioner moved an application for bail before the Court of learned Addit
ional Sessions Judge-cum-Special Judge (Vigilance), Bolangir which was rejected on 21.12.2015.
Learned counsel for the petitioner submits that the petitioner is in c
ustody since 05.12.2015 and he has been charge sheeted under sections 366/323/376/506/34 of th
e Indian Penal Code. It is the contention of the learned counsel for the petitioner that the v
ictim is a consenting party and she moved with the petitioner from place to place and also sta
yed with the petitioner in the house of one Arun Tandi and the ingredients of the offences are
