This matter is taken up through hybrid mode.

Petitioner in this writ petition prays for a direction to

the Executive Officer, NAC, Dhamnagar-Opposite Party

No.3 to demolish the half-constructed Pradhan Mantry Awas

Yojana (PMAY) house of Opposite Party No.5, namely,

Nishikanta Roul and after demarcation, evict him from the

land of the Petitioner.

Mr. Padhi, learned counsel for the Petitioner submits

that Opposite Party No.5 has been granted assistance under

the PMAY Scheme for construction of a house. But, by

encroaching upon the land of the Petitioner in Plot No.2167

under Khata No.329 of Mouza-Talapada under Dhamnagar

Tahasil in the district of Bhadrak, he is proceeding with
